This does not look like the happiest shrub I have ever seen but it should bounce back if cared for. It looks like photinia to me. It could use a good trimming then regular watering.

Purple Leaf Sandcherry?
I've noticed it's not a good year for them here this year.

Annette, is that a tree that would put out fruit?

I looked up the sandcherry and it doesn't really do edible fruit. It is grown for the foliage.
